Nursery boss fined for breaking gas laws

THE boss of a children’s nursery in Morecambe could have put his staff and children in danger by illegally fitting a new boiler.

John Gardner, managing director of Abacus Day Nursery on Claremont Road, was fined £2,300 after pleading guilty to breaching gas safety regulations.

Gardner removed and replaced a gas boiler at the nursery and installed a new combination heating and hot water boiler.

According to law, only Gas Safe registered engineers are allowed to do this.

Gardner was fined £500 for each offence and was ordered to pay £1,285 costs and a victim surcharge of £15.

Councillor David Kerr said: “In cutting corners and doing the work himself, Mr Gardner exposed his staff and the children in his care to potential danger.”

As part of the investigation, an officer for Gas Safe carried out checks on the boiler and identified certain safety defects which have now been rectified.

The prosecution came about following a routine food and health and safety inspection last June.

Mr Gardner did not wish to comment.
